Canada’s food safety authority revealed it aims to initiate a total removal of hundreds of ostriches at a farm following the supreme court declined to stop the contentious eradication.

Legal Obstacles Cleared by Court Ruling

Thursday’s ruling removed all judicial obstacle to commencing the slaughter.

Universal Ostrich Farms, situated close to the community of Edgewood, was first ordered in the month of May to eradicate almost four hundred birds, due to fears of an outbreak of H5N1 avian flu.

Recently, officials seized control of the business.

Sixty-nine birds have previously perished after the outbreak of a influenza-like sickness.

Midweek, Canada’s supreme court granted an interim stay on the cull order as it weighed whether to take up the matter.

The growing row over the birds – and a lingering post-pandemic skepticism – have motivated protesters to descend on the farm, with many broadcasting their anger on social media.

The situation has also penetrated the nation’s political sphere.

Earlier this fall, the opposition leader, the Tory leader, was questioned repeatedly by reporters whether he backed protesters.

The Tory leader has steered clear of making specific comments on the matter, despite many within his political group protesting against the slaughter.

He informed reporters the situation had been “mismanaged from the very beginning” but didn’t say the word the bird’s name.

International Interest and Proposals

A number of high-profile individuals from the United States have lobbied Canadian officials.

The US health secretary offered to relocate the ostriches to his property in Florida.

An US billionaire has also pleaded with the authorities to rescind its eradication directive.

Scientific and Ethical Arguments

The national authorities stated the relevant agency was following a eradication approach in order to contain the spread of bird flu, a move consistent with broader advice from global health organizations.

However, animal advocacy groups have urged the authority to perform further testing on the birds to confirm they are infected.

The farm owners said that because the most recent fatality happened on 15 January 2025, with the surviving majority seeming healthy or recovered, the flock has developed at least some level of immunity against H5N1.

They have also expressed skepticism on the scope and effectiveness of the tests on the birds.

Ranch Representative Reaction

On Thursday, the farm’s spokesperson, informed the press that the agency was “murdering” birds in good health.

“These are prehistoric animals that have endured millions of years, but they won’t endure the government agency,” she stated.

A co-owner said he was “afraid that there is no justice left”.

Judicial and Agency Decisions

A federal court, however, found that permitting the birds to stay alive could lead to the transmission of avian influenza to different species, the poultry industry – or to humans.

The agency has not said when it plans to begin culling the ostriches.

Eradication Methods

An older guideline document, acquired under public access laws, states ostriches can be euthanized by various methods, the recommended being injection, which requires multiple individuals: one to hold the bird by restraining it, another to secure the head, and one to inject the drug.

Personnel can also use gas chambers or break the birds’ necks.

Employees of the agency can only use firearms on the ostriches in extreme circumstances, if they have a trained shooter on the premises.
